Yes, however, it hasn’t been said whether or not those files where widely available, or if any were downloaded. However, the RIAA is still maintaining that rips of CDs are still considered “unauthorized” and it seems that the RIAA wants to tack on that idea to the pending lawsuit to get the judge to formally rule on the matter. So while the ripping of legally acquired CDs isn’t the focal point of the latest lawsuit, it will be an important issue.
