Even if the record company does have an elite legal team, they really wouldn't be able defend themselves from this strong of evidence, as long as the original authors correctly copyrighted their material.
January 18th, 2007

this is tragic. f*ck timbaland. i hope he goes bankrupt and back in the ghetto. 5 stars for the cause of tempest.
January 18th, 2007

nothing new... in rap some 60 or 70 % of all the beats/music whatever is unoriginal... still the tempest version is the best... that sh*t owned.

I am so glad the music industry does not want us to steal and it's ok for them to steal

He should have done legal action. He'd have gotten a settlement just to avoid the bad press.. as it stands, there's nothing we can do. Unlike eBaum's, the world of rap is mostly isolated from the word of us "net warriors" to the point they have probably never even heard of any site that is not MySpace or YouTube.

Actually there really is nothing illegal about the distribution of the free ringtone, though no credit is given, all rights are released when he released the song to the public seeing as how it wasn't the actual song that was posted, but rather the data/code to be converted to music by the end user (think ala music sheets). BUT seeing as how Timbaland probably was given some money indirectly, through a contract to produce a certain amount of "free" ringtones, it isn't right and credit SHOULD be given.

SIDs and MODs were both great music formats. You could have hours of music with random tunes and sounds and they virtually used no memory. I guess this guy thought he could get away with it because not enough people would know. Well, glad there are a few good people spreading the word. It makes my blood boil when some sleaze is taking credit and making money from an honest man. He's got a point about the situation being hopless though.

Please don't give up! Please don't roll over about this--they OWE YOU! that music is YOURS! You DESERVE the credit!! GET UP, man! GET UP and FIGHT! PLEASE! You deserve better than this! AT LEAST some royalties! ;_; This isn't fair...! They're not even acknowledging you... ... don't let them walk all over you...

This guy just lives in the wrong country. In US lawyers would crawl out of the woodwork to do this on contingency. In soviet Russia......uh, I gotta go poo.

January 18th, 2007

it's wrong that that artist stole it...but, i mean, the song itself is pretty bad...i think it's worse when hip hop artists have to steal BAD songs in order to remain popular

What BS This is why I think record labels should just shut up about their copyright crap. They've been stealing from the little guy for decades/centuries/who knows how long. It's ridiculous. Also, the song was much better before he touched it. I don't like that Nelly Furtado version. It's pretty stupid and doesn't go with the music at all. And also she is lame.

Solid. Well presented ... I guess he figured, "Hey, some internet tracker no one's ever heard of, from England or some sh*t... it's public domain, right ? Who's gonna sue ?" ... Of course, they'd need to prove that this was put on a fixed medium before the song published... I'm not sure how the courts feel about mp3/tracker mods. And I assume there's no publishing/performance rights org. for Timbaland to pay mechanical rights to. And what jurisdiction ? Dunno. But I bet we see more of this soon.
January 18th, 2007
(0)
I saw this on youtube first and said "holy sh*t, what a mother f*cking piece of sh*t!" being a producer myself this is a complete disgrace... Much like all current music you can find in the mainstream. Anyways, 5 stars. Timbaland is a f*cking sack of sh*t.
January 18th, 2007
(0)
The song is pretty good on its own, but tacked into a hip hop song it sucks. Five stars for the outrage, though.
January 18th, 2007
(0)
ive always loved this song...actually, i just heard it and wanted to sound cool, but yeah after hearing the whole version, its sad to know all that became of it was a sampling for the hip hop curse that ultimately ruined our society

January 19th, 2007
(0)
Timbaland sucks anyways.
January 19th, 2007
(0)
I do agree, though, that they are entitled to credit and cash muuuney, but keep in mind that the song was bad and in no way contributed to Nelly's album sales. Despite this, Timbaland is still one of the best music producers out there.
January 19th, 2007

Janet Jackson somewhat recently used a sample from one of the songs in Assault Rigs for the PS1. This sort of thing happens all the time, and no one does anything about it.
January 19th, 2007

I'm sure Gnarls Barkley gave appropiate credit, but if you can manage to find a way to make him suffer too, I would be much obliged. K THZX

Ever look at the liner notes of a rap CD? Samples are now listed after the songwriting credits and royalties are paid to the original artists. If "Tempest" actually grows a pair and begins legal action, chances are the record company will settle out of court and he'll get paid.

http://www.fairlight.fi/tempest/
January 19th, 2007

That's not the first. The Timbalanad sample for Missy Elliot's "Lose Control" sounds to be a ripoff of Gescom song (can't remember which one.) The sounds, tones, riffs, all sound the same.
January 19th, 2007
(0)
What's the point of this site? To inform? Ok, so Tempest should pursue legal action and get whats his. Did we really need to make a YTMND for that?

Lose Control is based on Clear by Techno pioneer Juan Atkins. As far as I know it's fully licensed and credited. There's no way they'd get away with stealing such a classic.
January 19th, 2007
(0)
Wtf is with this? This sh*t happens every day int he music industry. It happens every day in almost any major industry. WHO GIVES A F*CK? The only reason ebaums goes under attack is because most of the people he steals from never even got 15 mins of fame. Or he f*cks with a sites user base who mostly consists of people that have half a life at best and need something to occupy thier time. And I'm not excluding myself in this rant because I am one of those users lol. I'll give you a two just because your rat
January 19th, 2007

Ill give you a 1 simply because your rating and views are WAY over inflated for this type of ytmnd. Only way this should be getting this much views is if it was sponsored.

"It is Time that YTMND's true nature shall be heard throughout the world, we are the protectors of the weak, and the honest, and the noble. We at YTMND must bring justice to an injustice, we cannot live another day while people out there steal for profit and fame, are you all with us, or against us, lets let the world know NOW !!!!!!" Omfg, that is so lame. Ytmnd has no value whatsoever outside of the silly internet entertainment that has become so trendy, and I don't see that changing. Ever.

oh noes, timbo sampled from a free loop running around a series of tubes. how about, if you're going to put your music on the internets, and you're afraid of these types of things happening, voicetag and/or copyright it. don't get mad because some 8bit song you submitted in a contest one evening gets "stolen" by a producer who probably assumed the artist wouldn't care given its quality. besides, the SID version sounds like a bad Street Fighter II MIDI.

And for the record, I DO think that people who get paid substantial amounts of money by sampling off of others should give credit where credit's due. But come on...both this song and the original blow. 1'd because of the "OMG RAPPERS ARE ALL THEIVES" attitude implied in the YTMND and expressed in the comments.

"Hip Hop is dying, which actually used to be a decent genere of music back when they could actually make an orignal song." - Interpol ...BACK WHEN hip-hop first started out, every beat out there was derived from looped cuts and drum breaks "stolen" from old jazz, funk, or disco tracks. Synths and live instrumentation didn't gain prominence until the mid-90's, earliest. Don't pretend you love the genre's "oldschool" variant when you clearly hate the tools used to create it.

Timbaland steals, big deal. So does half the internet kids on here who pirate (er sorry, I mean "try out") ISOs, Apps, mp3s, blah blah. Sampling/stealing has been a hallmark of hip-hop for years. Hell, I hate to imagine how many pirated copies of photoshop are used to create all the gifs on this site lol. I am guilty of thievery too but I admit it and don't go out and demonize others who are doing the same.

Damn that's old-school... but just in case you haven't heard, the MAJORITY of rap consists of taking someone elses song and laying over drums, bass and anything else deemed necessary to make a hit song. So in light of that.. this isn't very surprising.

Meh, he sampled 3 loops from an 8 loop song. That's not exactly copying the entire song. He also added additional layers to the 3 loops to give it a fuller and outright better sound. He did a few other things also to make it distinctive from the original and if you juxtapose them with the same timing you'll notice a real difference. Also it's funny how noone publicizes when white artists jack from black artists however when a black artist samples (albeit without recognition) a white artist, it's everywhere.
