It's true that those conditions help in consideration of use of copyrighted material being protected as fair-use... but that's not air-tight protection by any means. Non-profits aren't strictly exempt, that's a common misconception. There's no agreement as to how little can be used cause it's all in these nebulous subjective terms. Fair-use for parody is also thin ice. Precedents in these cases are almost never conclusive - it comes down to who has the $$ to fight it out...
And instead of getting something of the Cornell website you might want to look into the actual statutory construction of these terms in the different jurisdictions implicated in any alleged copyright infringement. Some general Contract Law page for first-year students isn't really valid information. But yes... spamming makes us all look like children and some of us are clearly old as sh*t.
So is anyone going to court against ebaums world? I mean is everyone who had content stolen all talk? I've just been wondering if it's just going to remain a childish internet war? I want to see some action, I want to search google news for ebaum and get hundreds of court cases against ebaums world you know? But I doubt anyone will bother, which is a shame....Anyway on this ytmnd, well said, someone had to say it 1,337 stars for you!
Then when come's the next day at court, simply give the money back to mr.bauman, use his own actions against him in court, and everyone at trail will know money can't buy everything. If he say's "I bought it fair and square", say "Did I say I would sell my 'Content' to you or anyone at all?", ???, Profit.
YTMND is a parady site regardless of if "Max" profits or not. Most users here don't have the cash/determination to take ebaum to court, and I personally don't think they would win their case anyway depending on what state they choose to fight in. Spamming the forums is fun to watch, and I'm sure causes quite a bit of hassle to ebaum's moderators and such. I would imagine it also increases traffic here. So f*ck your maturity.
this is just a good a reason for us, the ytmnder's/interneters, to make our own material, use our own imagination and skills. so if that prick (eric b) does steal it u can take his *ss to court and put him down for good, also get alot of money :> but i still think the ebaums' forum member should still atleast be made fun of for being followers/supporters of that "guy".
Uhh, WRONG. The fact that YTMND is non-profit doesn't mean that it is protected under copyright law. Read the sentence in your YTMND regarding copyright law again. Not only does it have to be non-profit but the material can only be used for "criticism, comment, news reporting, teaching, scholarship, or research." YTMND is none of these things.

Youtube posts videos that are still being sold as DVDs, and shows that are still aired, etc. That detracts from the materials worth and is an infringement, nonprofit or not. OGROK, find me a YTMND with copywrited material that isn't a parody. Really.
Ebaums STEALS the content and the only change to that content it to add is watermark. There was not reactivity or thought that went into what he does. In addition, some of his sites are not even hosted on his site. He leached the Cornholio sound board and shut the guy down. YTMND users, for the most part, edit the content and make something new from it. The YTMND usage is still copyright infringement. At least, at a minimum, it’s creative.
Yeah to your stupid little Phoenix Wright thing I would of just said thats the dumbest loop-hole ever. Thatd be like me saying "Hey Sentry (a friend of mine in RL) I made a place to upload user created submissions on www.ergwow.com (my site dont go there its a WIP) so I would like to see *random copywritten material* on there but I cant so would you??"
Good points, the thing is that if you do take it out on eBaums forums in mass raids such as the YTMND-Day attack, you're in effect f*cking over the entire website by crashing the servers. Generic spamming is just that, retarded and done by NARVs. On the other hand, most "stolen" content on YTMND is also heavily modified from its original state. If it's not, then it usually sucks and gets low ratings. In addition, Max isn't responsible for that content.
Wait a second here...
YTMND's funny and entertaining content comes from stolen things, yes. But what makes them funny or entertaining is the very original and creative editing coming from registered users, from simple jokes, to something along the wide array of very original inside jokes ytmnd has (that ebaumsworld doesn't). Ebaumsworld registered users do not do anything creative for their site, rather they steal things and submit them. Ebaumsworld then claims responsibility of the content.
