We're talking UK. I just don't know much about British Common Law, but I know that companies sue for infringement and celebrities sue for defamation in the UK more often than in the US because they don't have quite as broad interpretation of protected speech in precedence. That's my guess for why the C&D letter is from Sega-Europe and not Sega-USA.

I don't know much Internet Law, but if the forum is in the UK, YTMND might have limited legal recourse... So the question is, does the UK have jurisdiction over YTMND???

(actually, probably "Where is the company that owns the servers located?" or, simply, SEGA could send a letter to the hosting company and they could shut down ytmnd from there. Most companies would fold to the threat of legal action simply because they can't bear the costs of a trial...)

The only thing is, sites are eligible for sponsorship, so the case could be made that it was commercial use. 2 for not being a lawyer, and bad color.

YTMND doesn't make the sites you moron, the users do and the users sponsor their own sites for the most part. If anyone is going to be sued, it's the users. There's no DIRECT sale of the sites by YTMND. Now STFU & GTFO.
